Terms and Conditions of Use

These Terms and Conditions govern the access and use of DRAPE, a Software as a Service (SaaS) platform operated from the Republic of Peru, which uses artificial intelligence to generate virtual human models and digitally modify garments and styles.

By accessing, registering, or using DRAPE, you expressly accept these Terms. If you do not agree, you must not use the Platform.

1. Service Description

DRAPE is a technological platform that allows its users to:

  • Generate virtual human models using artificial intelligence.
  • Change, adapt, or overlay digital garments and accessories.
  • Create visual content for e-commerce, marketing, design, and other lawful purposes.
  • Download and use the results in digital format.

The results generated by DRAPE are approximate representations created by AI systems and do not guarantee absolute accuracy with respect to real products, bodies, or materials.

2. Legal Capacity

The use of DRAPE is permitted only to persons over 18 years of age or with legal capacity in accordance with Peruvian Civil Code. By using the Platform, you declare that you meet this requirement.

3. Registration and Account

The user is responsible for:

  • Maintaining the confidentiality of their username and password.
  • All activity performed from their account.
  • Providing truthful, complete, and updated information.

DRAPE may suspend or cancel accounts that violate these Terms or misuse the Platform.

4. Permitted Use and Prohibitions

The user agrees to use DRAPE only for lawful purposes.

It is prohibited to:

  • Generate illegal, offensive, deceptive content, or content that infringes third-party rights.
  • Create representations of real people without their consent.
  • Generate or modify images of minors for inappropriate or sensitive purposes.
  • Use the Platform for fraud, misinformation, or identity theft.
  • Attempt to interfere with the security or operation of the system.

5. Intellectual Property

5.1 Platform

All software, AI models, algorithms, design, brand, and technology of DRAPE are the exclusive property of DRAPE or its licensors and are protected by Peruvian legislation and international treaties.

Use of the Platform does not grant intellectual property rights to the user.

5.2 User Content

The user retains ownership of the content they upload and grants DRAPE a limited, non-exclusive, and free license to process it solely for the purpose of providing the service.

5.3 Generated Content

Unless expressly stated otherwise, the user may use the content generated by DRAPE for commercial or personal purposes, under their sole responsibility and in accordance with the law.

6. User Responsibility

The user is solely responsible for:

  • The content they upload or generate.
  • The use they make of the results obtained.
  • Compliance with copyright, image rights, trademarks, and applicable regulations.

DRAPE assumes no responsibility for third-party claims arising from the use of generated content.

7. Personal Data Protection

The processing of personal data is carried out in accordance with Law No. 29733 – Personal Data Protection Law, its regulations, and DRAPE's Privacy Policy.

The user authorizes DRAPE to process their personal data for:

  • Service provision.
  • Technical support.
  • System improvement, in anonymized or aggregated form when applicable.

DRAPE adopts reasonable security measures to protect information.

8. Plans, Payments, and Billing

  • DRAPE may offer free plans and paid plans.
  • Economic conditions are informed before contracting.
  • Payments are non-refundable, except as provided by Peruvian legislation.
  • DRAPE may modify rates by notifying in advance.

9. Service Availability

DRAPE does not guarantee continuous availability or absence of errors. The service may be temporarily suspended for maintenance, improvements, or other technical reasons.

10. Limitation of Liability

To the maximum extent permitted by Peruvian law:

  • DRAPE shall not be liable for indirect damages, loss of profits, loss of income, data, or reputation.
  • The service is offered "as is" and "as available".
  • DRAPE's total liability shall not exceed the amount paid by the user in the last twelve (12) months.

11. Indemnification

The user agrees to indemnify and hold DRAPE harmless from any claim, penalty, or damage arising from misuse of the Platform or breach of these Terms.

12. Termination

DRAPE may suspend or cancel user access for breaches. The user may cancel their account at any time.

13. Modifications

DRAPE may modify these Terms at any time. Modifications will take effect from their publication on the Platform.

14. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Republic of Peru. Any dispute will be submitted to the competent courts of Lima, Peru.
